Stock Photography Trademark & Copyright Restrictions

In the world of stock photography there are certain places, landmarks, products and logos that are protected by Intellectual Property Rights. We have compiled a quick reference list to help you stay on top of Stock Photography Trademark and Copyright Restrictions.

There are certain images that are allowed to be used that contain trademarked places, buildings etc. For example images of cityscapes can be used in a commercial setting when there is no primary subject or one particular building in focus. If you have any question or concerns about an image that you think may be unacceptable for commercial use please contact Media Bakery and one of our licensing professionals can help answer your questions.

  • Cell Phones (unless all noticeable logos or distinguishing marks are removed)

  • Easter Eggs – Many Complex Easter Egg Painted Designs are copyrighted artwork so make sure there is a property release available if you want to use these images.

  • Love Keys – This restriction also extends to images of keys that contain the word “love” attached to them.

  • QR Codes – Images that feature QR Codes are acceptable, but the QR code cannot link to anything.

  • Shinkansen (aka Japanese Bullet Train)
  • Shoes (Isolated) with visible logos – only generic shoes can be accepted for commercial use.
  • Signatures

  • Smiley Face – Smiley has been a registered trademark in some countries since 1971.
  • Smirnoff Vodka Bottles
  • Soccer, Rugby, and Volley Balls – any of these balls must be blank or feature the generic pattern design
  • Stuffed Animals & Toys – double check the copyright as many are protected
  • Sunglasses with visible logos – only generic sunglasses can be accepted for commercial use.
  • Tattoos – you must have a model and property release to sell images with tattoos in them for commercial use.
  • TGV (Train à Grande Vitesse) – France’s high-speed rail service.
  • United Nations Flag and Emblem
  • Vehicles (Automobiles) with visible logos – only images where the automobile is not the main focus of the image are acceptable.
  • Verifone Credit Card Readers
  • Viewmaster
  • Wall of Screens – The concept of Multiple Screens on a Black Background or Wall of Screens is copyrighted.
  • If the image has any of the following it is unacceptable for commercial use: Reflection on floor; or Curve in monitor placement; or Man watching monitors
  • Wallpaper – Wallpaper designs may be protected by copyright as they are considered artwork.
  • X-Rays, MRI’s & CAT Scans – these are unacceptable if they contain patient information, doctor information, medical information, medical codes, or any other identifying information.
  • Brands/ Trademarks:
  • App Store – The term “App Store” and Apple’s App Store logo are protected under trademark.
  • Books – If there is any discernible text in, or on, any book  the image is unacceptable for commercial use, including bibles and dictionaries
  • Adidas – The complete Logo, word, and 3-stripes design are all protected under trademark.
  • Airstream – The word “Airstream”, and the design are registered trademarks of Airstream, Inc.
  • Android
  • Apple – All Apple designed products are registered trademarks of Apple Inc.
  • Boot Stitching – Certain manufacturers use elaborate stitching designs and any image where you can identify the boot by the stitching is not acceptable for commercial use.
  • Bluetooth – The Bluetooth word, mark, and logo are all registered trademarks.
  • Botox – The Botox logo and the term “Botox” are both protected by trademark.
  • Burberry – The black, tan, and red pattern know as “haymarket check” or the “Burberry classic check” is a registered trademark.
  • Caterpillar – Manufacturer of construction, mining equipment, diesel & natural gas engines, and industrial gas turbines.
  • Coca-Cola products
  • Comics (DC and Marvel, etc.) – All characters, names, logos, slogans, books, titles, and related indicia are protected by trademark and copyright.
  • Crayola – All Crayola art products and the swirl design are copyrighted and trademarked.
  • CrossFit – The words “CrossFit” and “CrossFit for Hope” are registered trademarks.
  • Czech Medical Cross
  • Diamond Jubilee Emblem
  • Disney – logos, products and word-marks cannot be used.
  • Department of Treasury Seal – The official seal, names and symbols of the US Department of Treasury cannot be used.
  • DVD Logo – This logo is restricted to licensed manufacturers only and may not be used.
  • E-Book Readers (e.g., Amazon Kindle, Nook) – E-Book Readers may be protected by design copyrights so make sure they are not the primary focus of the image and that there are no discernible logos or marks.
  • FIFA World Cup Logo and Trophies
  • Firewire – Specific brand name of IEEE 1394 serial bus interface.
  • Garmin – Brand of international navigation and GPS equipment.
  • The Green Dot –  This mark consists of two green arrows forming a circle, one lighter than the other. This symbol is a recycling standard controlled and operated by Duales System Deutschland AG (DSD).
  • Harley Davidson Motorcycles, logos and products, insignia’s, names and/or keywords cannot be used.
  • Hershey Products (Hershey Kiss) – The configuration of the paper flag, the shape of the candy, and the foil wrap are all registered trademarks.
  • IBS Bibles – Including NIV®, NIrV®, and TNIV® are registered trademarks of IBS in the United States and other countries.
  • I Love NY Logo (I ♥ NY)
  • Internet Icons – Including Internet Explorer, Safari, Mozilla Firefox, and Google Chrome.
  • John Deere Machinery (farming equipment, unique green & yellow design) and the Logo or Symbol, green & yellow color scheme are trademarks of Deere & Company.
  • KSB Logo – (pumps and valves manufacturer)
  • Las Vegas Skyline/Theme Hotels – All Las Vegas theme hotels and their recognizable buildings and parts are strictly controlled and are not permitted for commercial use.
  • Lego – Images featuring Lego products (including bricks) are unacceptable.
  • Levi’s Jeans Designs, stitching pattern, Red Tab device, and company name on Buttons are all trademarked.
  • Little League – The terms “Little League,” “Little Leaguer,” and “Little League Baseball,” Images containing these terms as a keyword or in the title/description are unacceptable for commercial or editorial use.
  • Lindt Chocolate Bunnies – Including the Gold Foil Chocolate Bunny wearing Red/Brown Ribbon and/or Bell; or
    Red/Brown Ribbon around neck on Chocolate Bunny; or Chocolate Bunny wearing ribbon with bell.
  • “Little Trees” air freshener
  • Louis Vuitton Items – Including anything that has the name Vuitton or the monogram “LV” and the checkered pattern. Note: This rule also applies to Louis Vuitton inspired items.
  • LTI Black Taxi
  • Made in Nature – Made in Nature is a company that produces organic dried food. – The “Made in Nature” logo, packaging, as a keyword, or in the title/description cannot be used commercially.
  • Mars, Inc. / Bounty Bar – Whether wrapped in packaging or unwrapped they are protected by trademark.
    Images of chocolate products may not contain the following list of keywords for commercial or editorial use: Mars, Mars, Inc., Bounty, Bounty Bar, Snickers, M&M’s, Twix, Milky Way, 3 Musketeers, etc.
  • Mattel – This includes Barbies, Bratz, Fisher Price, and Hot Wheels.
  • Major & Minor League Sports Logo and Merchandise – All major and/or minor league logos, emblems, merchandise, colors, hats, jerseys or socks are protected by trademark.
  • MLB, NBA, NFL, PGA, MLS etc. may not be used commercially.
  • Michelin and their brand of tires.
  • Movember
  • Mon Cheri Boxes
  • Peeps
  • Pepsi – All brands, designs, logos are protected by PepsiCo.
  • Pink Lady Apples- Any stickers or tags marked “Pink Lady” or “Pink Lady Apples” are unacceptable for commercial use.
  • Polaroid – “Polaroid” cannot be used as a keyword or description for any image.
  • Red Cross & Red Crescent Symbols
  • Seals of the United States – Including but not limited to: Great Seal of the United States, Seal of the President of the United States, Seal of the Vice President of the United States, Seal of the United States House of Representative, Seal of the United States Congress, Seal of the Department of Treasury, etc.
  • Scrabble
  • Shure 55SH & Super 55 Microphones (aka “Elvis” Microphone)
  • Social Media Icons – This includes, but is not limited to, Facebook, Twitter, Instagram, Spotify, Pandora, iTunes, eBay, etc., Commercial images may not use the name of a social media platform as a keyword.
  • Social media platform names may be used as a keyword for editorial images where the keyword is accurate.
  • The words Spin, Spinning, the Spinning logo, Bodyblade, and Peak Pilates are registered trademarks.
  • Stabilo Highlighters’ logo and design are trademarks of Stabilo International GmbH.
  • Images containing the Steak ‘n Shake logo cannot commercially. You may not use the term “Steak ‘n Shake” as a keyword or in the title/description in anyway for commercial use either. This is true for many trademarked brands so be careful with keywords and titles as well.
  • You may not use the trademark Teflon as it is trademarked by DuPont. Further more you may not use the word “Teflon” as a keyword in any image featuring a product or products.
  • You may not use any images containing insignia of a nation’s active military service. Including but not limited to agency insignia, military decorations, golden eagles and presidential seals.
  • The United States Playing Card Company has a registered trademark on all decks of cards.

Editorial Images (These images can be used only for illustrating non-advertising materials in the press. Usually such pictures are used in news sector.)

  • Example of editorial use only is professional racing logos, events (Macy’s Thanksgiving Day Parade), art instillation’s, images of celebrities, pro sports teams, etc.
  • Images containing the Steak ‘n Shake logo are acceptable for editorial use with a proper caption. Images submitted with the term “Steak ‘n Shake” as a keyword or in the title/description are acceptable for editorial use.
  • You cannot use words or phrases in your keywords or photo descriptions that contain trademarked words such as Starbucks, and GoPro. So make sure you check the trademark website before using a major brands name or logo in any of your projects.
  • MLB, NBA, NFL, PGA, MLS etc. May be used as editorial with proper caption.
  • Social Media Icons may be used and Social media platform names in keywords can be used for editorial images.
